Having examined ex officio, in camera, the case concerning appointment of a receiver as part of the bankruptcy proceedings of Kraków Business Park spółka z ograniczoną odpowiedzialnością w likwidacji w Zabierzowie w upadłości likwidacyjnej on 14 April 2016 in Krakow,

the District Court for Krakow – Śródmieście in Krakow, 8th Commercial Division for Bankruptcy and Restructuring, composed of:

hereby decides:

In relation to the decision of the Court of 4 February 2016 on the dismissal of the receiver, appoint Zimmerman Filipiak Restrukturyzacja S.A. in Warsaw as the receiver, and, at the same time, dismiss Zimmerman Filipiak Restrukturyzacja S.A. in Warsaw from the position of the interim administrator.

1.    Declaration of liquidation bankruptcy and appointment of the official receiver

District Court for Krakow-Śródmieście in Krakow, 12th Commercial Division of the National Court Register. Date of entry in the Register: 2003-07-04 File Ref. No. VIII GU 331/13/S, VIII GUp 12/14/S District Court for Krakow-Śródmieście in Krakow, 12th Commercial Division for Bankruptcy and Reorganisation announces that, pursuant to the decision of 31 March 2014, file case No. VIII GU 331/13/S, KRAKÓW BUSINESS PARK Spółka z ograniczoną odpowiedzialnością w likwidacji w Zabierzowie was declared bankrupt, which includes liquidation of its assets. Creditors are requested to submit their claims to the Judge-Commissioner by 30 June 2014. Persons, who have rights and personal rights, and claims on the real estate owned by the bankrupt, if they were not entered in the land and mortgage register, are requested to submit them by 30 June 2014, or they will lose the right to invoke them in the bankruptcy proceedings.

Janusz Płoch was appointed Judge-Commissioner. Marcin Żurakowski was appointed official receiver.

The bankruptcy proceeding will be conducted under the case ref. No. VIII GUp 12/14/S.

No. VIII GUp 12/14/S) announces that the official receiver prepared a record of claims and submitted it to the judge-commissioner and that the record may be reviewed in the secretariat of the District Court for Krakow-Śródmieście in Krakow, ul. Przy Rondzie 7, pokój 218, pawilon K.

I.   To dismiss Marcin Żurakowski from the position of the official receiver;

II.    To appoint an interim administrator – Zimmerman Filipiak Restrukturyzacja S.A. in Warsaw for the period before the final ruling on the dismissal of the receiver.

REASONS

In the submission of 21 January 2016, the official receiver Marcin Żurakowski resigned from the position of the official receiver in the bankruptcy proceedings for Kraków Business Park spółka z ograniczoną odpowiedzialnością w likwidacji w Zabierzowie w upadłości likwidacyjnej.

In the reasons, he listed the circumstances which justified the request submitted, including those related to the actions which had already been undertaken by the receiver in the course of the proceedings. (Request, sheets 2772 — 2775, Volume MV of the files)

Pursuant to the provision of Article 170.2 of the Bankruptcy and Reorganisation Law Act (the Act of 28.02.2003, consolidated text, Journal of Laws Dz. U. 2015, item 233, with subsequent amendments) in conjunction with Article 449 of the Restructuring Law ( the Act of 15.05.2015, Journal of Laws Dz.U.2015, item 978 ), the Court dismisses the official receiver at his request.

In the circumstances, as in the submission of 21 January 2016, Marcin Żurakowski resigned from the position of the official receiver; therefore, acting pursuant Article 170.2 of the Bankruptcy and Reorganisation Law, the Court ruled as in item I of the operative part hereof. Simultaneously, pursuant to Article 172.2 of the above Act, until the decision on the dismissal of the receiver becomes final, an interim administrator is appointed – Zimmerman Filipiak Restrukturyzacja S.A. in Warsaw, to which the provisions on the receiver shall be applied accordingly.
