Bartosz Sierakowski, Ph.D.

He specialises in debt restructuring for troubled businesses, protection of creditors’ rights, including execution through compulsory administration.

He has extensive experience in his field of speciality, which includes:

• Participation in proceedings before the restructuring and bankruptcy court as the attorney for the participants,
• Performance of activities of a court-appointed supervisor in arrangement proceedings and fast-track arrangement proceedings, and an arrangement supervisor in proceedings to approve an arrangement,
• He performs the activities of a supervisor in sanation proceedings,
• As an attorney, he advises administrators in the biggest restructuring proceedings in Poland,
• He performs the activities of an official receiver in bankruptcy proceedings, including secondary bankruptcy proceedings,
• He provides advisory services during execution through compulsory administration of the business,
• He participated in the biggest bankruptcy proceedings in the arrangement option in Poland, which ended in conclusion and enforcement of an arrangement (including in relation to a public company listed on the Warsaw Stock Exchange),
• He advised in reorganisation proceedings (only a few such proceedings have been effectively conducted in Poland),
• Advisory services in the course of so-called property developer bankruptcy, which was the first such bankruptcy in Poland,
• Negotiations with creditors, including financing institutions, to work out an out-of-arrangement agreement,
• Management of a team of lawyers, accountants and managers at the stage of preparation of arrangement proposals (restructuring schemes) and key submissions filed before the bankruptcy (restructuring) court.

He has extensive training and teaching experience. A speaker at national legal conferences. He conducts workshops for entrepreneurs and financial institutions in bankruptcy, restructuring and execution procedures. He is a member of the management board of ZiW Szkolenia sp. z o.o. He teaches Restructuring and Bankruptcy Law at postgraduate courses at Lazarski University in Warsaw.

A co-author of a practical commentary on the Restructuring Law (2016), a co-author of “Wzory pism procesowych i sądowych w postępowaniu restrukturyzacyjnym” (2016) [Model Submissions in Restructuring Proceedings], co-author of the commentary: “Ustawa o Bankowym Funduszu Gwarancyjnym, systemie gwarantowania depozytów oraz  przymusowej restrukturyzacji. Komentarz” (2017). [“The Bank Guarantee Fund Act, the system of guaranteeing deposits and compulsory restructuring. A commentary”. The author and a co-author of several dozen publications on restructuring, bankruptcy and execution law. He publishes his articles in, among others, Monitor Prawa Bankowego and Doradca Restrukturyzacyjny. He is also an expert for Dziennik Gazeta Prawna, Rzeczpospolita and TVN Biznes i Świat.
