Doctor of Juridical Science, Licensed Restructuring Adviser, President of the Management Board of Zimmerman Filipiak Restrukturyzacja S.A. Partner and founder of the FILIPIAKBABICZ law firm.
Co-author of the new Restructuring Law. For legislative work in that field, he was awarded an order of the Minister of Justice for service for administration of justice.
He is a member of the organisation of professionals who specialise in bankruptcy, business reconstruction and recovery INSOL EUROPE, the Business Law Team of the Minister of the Economy and the Team of the Minister of Justice for Amendment of the Bankruptcy and Reorganisation Law. An expert of the World Bank. A member of the Association of Restructuring Practitioners and the Bankruptcy Section of the Allerhand Institute.
A co-author and editor of a commentary on the Restructuring Law, a commentary on consumer insolvency and a commentary on the Regulation 1346/2000 on Insolvency Proceedings. A co-author of the System of Bankruptcy and Restructuring Law and several dozen other publications on business law.
He specialises in crisis management, restructuring of troubled businesses, management of assets of insolvent businesses and individuals, and in the protection of creditors’ rights in relation to insolvency of their debtors.
Since he obtained an official receiver license, he has held the position of an interim court-appointed supervisor, supervisor, administrator and an official receive (syndyk) in many proceedings before the bankruptcy court. The proceedings pertained to businesses operating in different industries which included construction, real estate, food production, retail sales or production of metals and metal products.
He has extensive experience in:
  • Proceedings before restructuring and bankruptcy courts,
  • Preparing and implementing restructuring schemes,
  • Obtaining new funding,
  • Crisis consultancy, including consultancy for big entities which operate in the form of groups of companies with participation of foreign capital and are at the risk of bankruptcy,
  • Supervising the correctness of conducting business activity (he gained his experience when holding a position of a member of supervisory boards, including the supervisory board of a public company)
  • Providing legal services to commercial companies and partnerships, including public companies from the energy sector (the project of construction of the largest conventional power plant in Europe including a coal mine, and wind farm construction projects),
  • Securing the company assets against destruction, damage or misappropriation by third parties,
  • Assessing the value of businesses and their individual assets.
He also has outstanding theoretical knowledge, which helps him to use law in the most effective manner under the circumstances. He is an assistant professor and lecturer at Adam Mickiewicz University in Poznan, where he teaches bankruptcy and reorganisation law at the Faculty of Law and Administration. He speaks at bankruptcy law and restructuring conferences and congresses.
